CA rental law

Required lease disclosures

disclosure
For landlord
Various; e.g., Cal. Civil Code §§ 1954.603, 2079.10a; Gov. Code § 8589.45

Plain language

California requires landlords to disclose several things in or with the lease, including lead-based paint (pre-1978 buildings), known mold, the Megan's Law database notice, bed-bug information, flood-hazard status, and (where applicable) AB 1482 coverage or exemption language.

Statute text

Common required disclosures include: federal lead-based paint disclosure and pamphlet for buildings built before 1978; the statutory Megan's Law database paragraph; known mold conditions; bed-bug information (Civil Code §1954.603); flood-hazard disclosure if the owner has actual knowledge or the property is in a flood zone (Gov. Code §8589.45); pest-control service notices; and, for AB 1482, either the just-cause/rent-cap notice (covered units) or the proper exemption language (exempt single-family/condo). Missing the AB 1482 exemption notice can cause an otherwise-exempt unit to be treated as covered.
