rent control
For both
Cal. Civil Code § 827

Plain language

Statute text

Civil Code §827 governs the notice period for rent increases on month-to-month tenancies: 30 days' written notice for a cumulative increase of 10% or less in the prior 12 months, and 90 days' notice for any increase above 10%. These notice rules are separate from the AB 1482 cap on the amount. Notice must be properly served (personal delivery, or mail with added days). For fixed-term leases, rent cannot be raised mid-term unless the lease allows it.
